Cardinal Health, a global health services and products company, to pay $ 1.45 million, and Los Angeles recruiting agency AppleOne to review policies to resolve racial harassment and retaliatory discrimination lawsuit filed by U.S. Commission for equal opportunities in employment, the federal agency said on Friday.
According to the EEOC, black employees assigned by AppleOne at the Ontario facility of Cardinal Health, as well as black employees directly hired by Cardinal Health, have been subjected to continuous and unwelcome harassment because of their race.
In addition to the monetary relief, Cardinal Health and AppleOne have agreed to two separate consent decrees that include an injunction aimed at preventing harassment, discrimination and reprisal in the workplace. The decrees include maintaining an equal employment opportunity monitor, carrying out audits, reviewing and revising policies prohibiting discrimination and distributing such policies to direct and temporary employees, and establishment of an internal complaints procedure.
Additionally, Cardinal Health and AppleOne have agreed to maintain a toll-free complaint hotline and provide discrimination training to all employees. Finally, Cardinal Health agreed to extend the decree for an additional year on the recommendation of the EEO monitor.
The decrees will remain under the jurisdiction of the Los Angeles federal court for at least two years.
“The EEOC has seen an increase in allegations of racial harassment in industries and communities,” said Anna Park, regional counsel for the EEOC’s Los Angeles district office. âIt is very important that employers and recruitment agencies are proactive in resolving these issues. Cardinal Health and AppleOne are being commended for making changes in their workplaces that will have a positive impact on their employees and the communities in which they reside.
Rosa Viramontes, Los Angeles District Director of EEOC, added that Cardinal Health and AppleOne “have put in place measures to prevent discrimination and harassment that other employers should also take into account.”
âEmployers and recruiting agencies need to understand that both entities have a responsibility to deal with and correct harassment and reprisal in the workplace,â she said. âEmployees shouldn’t have to choose between their livelihood and the damaging effects racial harassment can have on them. “
